That the meeting be closed to the public in order to deal with agenda items under the Community Charter:

Section 90(1) A part of the Council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:

(a) personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;

(b) personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the municipality on condition of anonymity;

(c) labour relations or other employee relations;

(e) the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure could reasonably be expected to harm the interests of the municipality;

(f) law enforcement, if the Council considers that disclosure could reasonably be expected to harm the conduct of an investigation under or enforcement of an enactment;

(g) litigation or potential litigation affecting the municipality;

(h) an administrative tribunal hearing or potential administrative tribunal hearing affecting the municipality, other than a hearing to be conducted by the Council or a delegate of Council;

(i) the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose;

(k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public;

(l) discussions with municipal officers and employees respecting municipal objectives, measures and progress reports for the purposes of preparing an annual report under Section 98 [annual municipal report]; and,

(n) the consideration of whether a Council meeting should be closed under a provision of this subsection or subsection (2); and,

 Community Charter Section 90(2):

(b) the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both, or between a provincial government or the federal government or both and a third party.

Purpose:  To provide Council with proposed siting guidelines for Federally-approved Supervised Consumption Sites, and to present Council with options for amendments to “City of Nanaimo Zoning Bylaw 2011 No. 4500” in order to allow supervised consumption sites within the city of Nanaimo.

Presentation:

1. Lisa Bhopalsingh, Manager, Community Planning.

Recommendation:  That Council provide direction with respect to supervised consumption site zoning amendments.

Purpose:  To amend “City of Nanaimo Zoning Bylaw 2011 No. 4500” and “City of Nanaimo Sign Bylaw 1987 No. 2850” to update the regulations pertaining to home-based businesses.

Recommendation:  That:

  1. “Zoning Amendment Bylaw 2020 No. 4500.149” (To amend the home-based business regulations) pass first reading;
  2. “Zoning Amendment Bylaw 2020 No. 4500.149” pass second reading;
  3. “Sign Amendment Bylaw 2020 No. 2850.22” (To amend sign regulations pertaining to home-based businesses) pass first reading;
  4. “Sign Amendment Bylaw 2020 No. 2850.22” pass second reading; and,
  5. “Sign Amendment Bylaw 2020 No. 2850.22” pass third reading.

Purpose:  To present Council with an application to rezone the subject property at 200 Hansen Road from Low Density Residential (R6) and Residential Corridor (COR1) to Medium Density Residential (R8) to allow for a multi-family residential development.

Recommendation:  That:

  1. “Zoning Amendment Bylaw 2020 No. 4500.172” (To rezone 200 Hansen Road from Low Density Residential [R6] and Residential Corridor [COR1] to Medium Density Residential [R8]) pass first reading;
  2. “Zoning Amendment Bylaw 2020 No. 4500.172” pass second reading;
  3. Council direct Staff to secure the vehicle turnaround covenant, blanket right-of-way, and residential units covenant should Council support the bylaw at third reading.

Purpose:  To present for Council’s consideration a development permit application for a proposed mixed-use building that will include multi-family residential units, live/work units, and commercial space.

Recommendation:  That Council issue Development Permit No. DP1133 at 930 Terminal Avenue North with the following variances to:

  • reduce the watercourse setback for St. George Creek from 15m to 7.5m;
  • increase the building height from 18.0m to 18.6m;
  • reduce the front yard setback from 5.5m to 3.6m;
  • reduce the required number of parking spaces from 56 to 54; and
  • increase the maximum allowable percentage of small car spaces from 40% to 45%.

Purpose:  To present for Council’s consideration, a development variance permit application to allow an oversized accessory building at 3358 Stephenson Point Road.

It is requested that Council hear anyone wishing to speak regarding Development Variance Permit No. DVP392 - 3358 Stephenson Point Road.

Recommendation:  That Council issue Development Variance Permit No. DVP392 at 3358 Stephenson Point Road with the following variance:

  • to increase the total gross floor area for accessory buildings on a lot from 90m2 to 171.8m2 to allow for the construction of an oversized accessory building at 3358 Stephenson Point Road.

Purpose:  To present for Council’s consideration, a development variance permit application to allow an over height fence and retaining wall at 4461 Wellington Road.

It is requested that Council hear anyone wishing to speak regarding Development Variance Permit No. DVP396 - 4461 Wellington Road.

Recommendation:  That Council issue Development Variance Permit No. DVP396 at 4461 Wellington Road with the following variance:

  • increase the maximum combined height for a fence and retaining wall within the rear and side yard setbacks from 2.4m to 3.51m.

Purpose:  To present for Council’s consideration, a development variance permit application to waive the frontage works and services requirements for the planned redevelopment of the Nanaimo Correctional Centre at 3945 Biggs Road.

It is requested that Council hear anyone wishing to speak regarding Development Variance Permit No. DVP397 - 3945 Biggs Road.

Recommendation:  That Council issue Development Variance Permit No. DVP397 at 3945 Biggs Road to vary “Building Bylaw 2016 No. 7224”, subject to the terms and conditions specified in Attachment A of the report.

Purpose:  To present for Council’s consideration, a development variance permit application to reduce the minimum required rear yard setback to legalize the construction of an existing single residential dwelling at 3951 Jingle Pot Road.

It is requested that Council hear anyone wishing to speak regarding Development Variance Permit Application No. DVP399 - 3951 Jingle Pot Road.

Recommendation:  That Council issue Development Variance Permit No. DVP399 at 3951 Jingle Pot Road with the following variance:

  • reduce the minimum rear yard setback requirement for the principle dwelling from 7.5m to 5.1m.

Purpose:  To inform Council that an application has been received to amend the existing liquor licence at 11 Cliff Street (Hub City Ales/Cliffside Brewing Company) to permit an outdoor patio and to extend the hours of service.

That “Zoning Amendment Bylaw 2019 No. 4500.133” (To rezone Unit 9, 1599 Dufferin Crescent to allow “Cannabis Retail Store” as a site-specific use in the Hospital Urban Centre [CC5] Zone) be adopted.

That “Financial Plan Bylaw 2019 No. 7307” (To confirm and adopt the 2020 – 2024 Financial Plan) be adopted.
