PROCEDURAL MOTION:

That the meeting be closed to the public in order to deal with agenda items under the Community Charter:

Section 90(1) A part of the Council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:

(c) labour relations or other employee relations;

(e)  the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure could reasonably be expected to harm the interests of the municipality;

(f) law enforcement, if the Council considers that disclosure could reasonably be expected to harm the conduct of an investigation under or enforcement of an enactment; 

(k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public; and,

(n) the consideration of whether a Council meeting should be closed under a provision of this subsection or subsection (2).

RISE AND REPORT:

a.

Warming Centre Services Expression of Interest Update

During the 2023-DEC-04 In Camera Council Meeting, Council directed Staff to  allocate $175,000 to fund a warming centre service at 2025 Bowen Road approximately from 2024-JAN-02 to 2024-MAR-31 and direct Staff to allocate $112,000 to fund a warming centre service at 5 Victoria Road approximately from 2023-DEC-17 to 2024-MAR-31 and that the warming centres be funded by a budget transfer from the Asset Retirement Obligation project surplus with the remaining funds coming from the Strategic Infrastructure Reserve. They authorized Staff to enter into a service agreement with Island Crisis Care Society and the 7-10 Club Society to:

• provide warming centre services during the identified service gaps; and,
• mitigate impacts on the surrounding neighbourhood through good neighbourhood agreement requirements.

b.

District 68 Sports Field Recreation Committee Council Appointments

During the 2023-DEC-18 In Camera Council Meeting Council appointed Councillor Thorpe and Councillor Hemmens as Committee representatives and Councillor Perrino as the alternate to the District 68 Sports Field and Recreation Committee for a term ending 2026-NOV-03.

Property Disposition - 350 and 398 Franklyn Street

To be introduced by Bill Corsan, Director, Corporate and Business Development.

Purpose:  To provide Council with background information on a proposed multi-family development on City-owned land at 350 and 398 Franklyn Street and to seek Council’s approval to dispose of the land to Camargue Properties Inc.

Presentation:

1. Robin Kelley, Partner, Camargue Investments Inc./ Le Groupe Denux, Coben Christiansen, Principal Design Architect, ACE Architecture, and Bryan Gartner, Senior Project Architect, ACE Architecture, via Zoom.

Recommendation:  That Council:

1. approve the disposition of 350 and 398 Franklyn Street to Camargue Properties Inc. for $1,600,000; and
2. direct the Mayor and Corporate Officer to execute the necessary documents to effect the transaction. 

b.

420 Albert Street - Acceptance of Project Under "Revitalization Tax Exemption Bylaw 2018 No. 7261"

To be introduced by Bill Corsan, Director, Corporate and Business Development.

Purpose:  To obtain Council approval for a multi-family development at 420 Albert Street to be included in the Downtown Revitalization Tax Exemption program.

Recommendation:  That Council approve the Revitalization Tax Exemption Agreement for a proposed multi-family development with 23 units at 420 Albert Street.

c.

Nanaimo Acute Response Table

To be introduced by Christy Wood, Manager, Social Planning.

Purpose:  To provide Council with an update on the Nanaimo Acute Response Table, and seek Council’s endorsement to sign an Integrated Program Agreement with the Province of British Columbia as represented by the Minister of Public Safety and Solicitor General, Minister of Social Development and Poverty Reduction, and the Minister of Children and Family Development.

Presentation:

1. Christy Wood, Manager, Social Planning.

Recommendation:  That Council authorize the Mayor to enter into an Integrated Program Agreement with the Province of British Columbia, as represented by the Minister of Public Safety and Solicitor General, Minister of Social Development and Poverty Reduction, and the Minister of Children and Family Development to support the activities of the Nanaimo Acute Response Table, also known as the Situation Table.

d.

Development Permit Application No. DP1301 - 532 Prideaux Street

To be introduced by Jeremy Holm, Director, Planning and Development.

Purpose:  To present for Council’s consideration a development permit application for a multi-family development at 532 Prideaux Street.

Recommendation:  That Council issue Development Permit No. DP1301 for a multi-family development at 532 Prideaux Street with variances as outlined in the “Proposed Variances” section of the Staff Report dated 2024-JAN-15.

General Amendments to City of Nanaimo Zoning Bylaw

To be introduced by Jeremy Holm, Director, Planning and Development.

Purpose:  To seek Council direction on next steps for general text and mapping amendments to the “City of Nanaimo Zoning Bylaw 2011 No. 4500”.

Recommendation:  That:

1. First reading of “Zoning Amendment Bylaw 2023 No. 4500.219” (General text and mapping amendments to “City of Nanaimo Zoning Bylaw 2011 No. 4500”) be rescinded;
2. Second reading of “Zoning Amendment Bylaw 2023 No. 4500.219” be rescinded; and
3. Council direct Staff to not hold a Public Hearing for “Zoning Amendment Bylaw 2023 No. 4500.219” and to provide notice in advance of first reading.
