That the meeting be closed to the public in order to deal with agenda items under the Community Charter:


Section 90(1) A part of the Council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:


(c) labour relations or other employee relations;


(e) the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure could reasonably be expected to harm the interests of the municipality;


(g) litigation or potential litigation affecting the municipality;


(k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public; and,


(n) the consideration of whether a Council meeting should be closed under a provision of this subsection or subsection (2).

That Council endorse the following guidelines, as attached to the Staff Report dated 2024-MAY-13, associated with the preparation of geotechnical reports and the assessment of mine-related geotechnical hazards in support of development applications within the City of Nanaimo:

  1. Guidelines for the Preparation of Geotechnical Reports; and,
  2. Guidelines for Geotechnical Assessments Above Abandoned Mine Workings.

That Council allocate $300,000 of the 2024 Pedestrian Unallocated Funds and reallocate $182,500 of the 2023 Pedestrian Unallocated Funds for a combined total of $482,500 toward Albert Street Crossing Improvements from Milton Street to Dunsmuir Street.

That Council approve the following Community Environmental Sustainability Project Grants:

  • Light House Sustainability Society - $2,500
    Project:  Building Material Exchange (BMEx)
  • Departure Bay Neighbourhood Association - $800
    Project:  DBNA Environmental Engagement
  • Altrusa Club of Nanaimo - $5,000
    Project:  Nurture Nature
  • Nanaimo Foodshare - $2,800
    Project:  Compost Revitalization Project
  • Nanaimo Old City Association with the Harewood Neighbourhood Association and Dover Community Association - $1,600
    Project:  Thermal Imaging and Home Energy Reduction Neighbourhood Project
  • Rock City Neighbourhood Association - $4,800
    Project:  Seed to Table Workshop

That Council approve the request from the Nanaimo Division of Family Practice for a Community Program Development Grant in the amount of $6,120 to assist in funding their Social Prescribing pilot program.

That Council approve the following 2024 Community Watershed Restoration Grants:

That Council accept the 2023 Statement of Financial Information for filing with the Ministry of Municipal Affairs and Housing.

That Council approve the following Community Environmental Sustainability Project Grant:

  • South End Eco Development Cooperative - $2,500
    Project:  The Toolshare Project

Purpose:  To present a housekeeping amendment to the Political Signage Regulation Bylaw to clarify that regulations associated with political signage within Provincial highway rights of way are governed by the Ministry of Transportation and Infrastructure.


Recommendation:  That:

  1. “Political Signage Regulation Amendment Bylaw 2024 No. 7335.01” (a bylaw to amend the provision associated with political signage in Provincial highway rights of way) pass first reading.
  2. “Political Signage Regulation Amendment Bylaw 2024 No. 7335.01” pass second reading.
  3. “Political Signage Regulation Amendment Bylaw 2024 No. 7335.01” pass third reading.

Purpose:  To obtain Council approval to close a portion of Northfield Road and obtain approval to enter into a Land Exchange Agreement with the owner of 2300 Northfield Road to dedicate part of their property for road in exchange for the road closure area.


Recommendation:  That:

  1. Council authorize the road closure and disposition of a portion Northfield Road, and direct Staff to enter into a Road Closure and Land Exchange Agreement;
  2. “Highway Closure and Dedication Removal Bylaw 2024 No. 7370” (to provide for highway closure and dedication removal of a portion of Northfield Road adjacent to 2300 Northfield Road) pass first reading;
  3. “Highway Closure and Dedication Removal Bylaw 2024 No. 7370” pass second reading; and
  4. Council direct Staff to proceed with public notice for the closure and disposition of a portion of Northfield Road.

Purpose:  To seek Council approval for the naming and renaming of two City roads to support the Midtown Gateway Project.


Recommendation:


Municipal Highway Renaming Bylaw

  1. That “Municipal Highway Renaming (Powder Works Road) Bylaw 2024 No. 7378” (to provide for the renaming of municipal highways) pass first reading;
  2. That “Municipal Highway Renaming (Powder Works Road) Bylaw 2024 No. 7378” pass second reading; and
  3. “Municipal Highway Renaming (Powder Works Road) Bylaw 2024 No. 7378” pass third reading.

  1. That “Municipal Highway Naming (Boxwood Road) Bylaw 2024 No. 7379” (to provide for the naming of municipal highways) pass first reading;
  2. That “Municipal Highway Naming (Boxwood Road) Bylaw 2024 No. 7379” pass second reading; and
  3. That “Municipal Highway Naming (Boxwood Road) Bylaw 2024 No. 7379” pass third reading.

Purpose:  To present for Council’s consideration a development permit application for a multi-family residential development at 307, 311 and 315 Holly Avenue. 


Recommendation:  That Council issue Development Permit No. DP1320 for a multi-family residential development at 307, 311 and 315 Holly Avenue with variances as outlined in the “Proposed Variances” section of the Staff Report titled "Development Permit Application No. DP1320 - 307, 311 and 315 Holly Avenue" dated 2024-MAY-27.

Purpose:  To obtain Council’s endorsement for an application to the Union of British Columbia Municipalities (UBCM) 2024 Community Excellence Awards, as required by UBCM.


Recommendation:  That Council endorse the City of Nanaimo’s application for City Plan: Nanaimo ReImagined, the Integrated Action Plan, and the Monitoring Strategy to be collectively considered for a 2024 UBCM Community Excellence Award – Excellence in Sustainability.

That:

That "Council Procedure Bylaw Amendment Bylaw, 2024 No. 7272.04" (a bylaw to include amendments resulting from Bill 44 as it relates to Public Hearings and other housekeeping amendments) be adopted.

That "Development Procedures and Notification Bylaw 2024 No. 7375" (to establish development and notification procedures) be adopted.

At the 2024-APR-22 Regular Council Meeting, Councillor Perrino advised that she would be bringing forward the following motion for consideration: 


“That Council direct Staff to provide an update with respect to the new pickle ball courts at Beban Park and options to reduce impact of the Beaufort Park courts in advance of the new courts opening.”
