That the meeting be closed to the public in order to deal with agenda items under the Community Charter:


Section 90(1) A part of the Council meeting may be closed to the public if the subject matter being considered relates to or is one or more of the following:


(a)  personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;
(b) personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the municipality on condition of anonymity;
(e) the acquisition, disposition or expropriation of land or improvements, if the Council considers that disclosure could reasonably be expected to harm the interests of the municipality;
(i) the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose;
(k) negotiations and related discussions respecting the proposed provision of a municipal service that are at their preliminary stages and that, in the view of the Council, could reasonably be expected to harm the interests of the municipality if they were held in public;
(n) the consideration of whether a Council meeting should be closed under a provision of this subsection or subsection (2); and,


 Community Charter Section 90(2):


(b) the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both, or between a provincial government or the federal government or both and a third party.

Mathew Coady, to speak regarding the importance of developing procurement guidelines that will assist with reducing toxic chemicals in the goods procured by the City of Nanaimo as part of its Sustainable Procurement Policy.

Joanne Dallman, to speak regarding Tiny Home Project - a plan to deal with homelessness in Nanaimo and other Canadian towns and cities.

Purpose:  To introduce “Financial Plan Bylaw 2022 No. 7359” for first, second and third readings.


Recommendation:   That:

  1. “Financial Plan Bylaw 2022 No. 7359” (To confirm and adopt the 2023 – 2027 Financial Plan) pass first reading;
  2. “Financial Plan Bylaw 2022 No. 7359” pass second reading; and
  3. “Financial Plan Bylaw 2022 No. 7359” pass third reading.

Purpose:  To obtain Council approval to amend the Tax Exemption Agreement for a proposed multi-family building at 507 Milton Street.


Recommendation:  That Council approve the amended Revitalization Tax Exemption Agreement for a proposed 27-unit mixed-use development at 507 Milton Street.

To be introduced by Dale Lindsay, General Manager, Development Services/Deputy CAO.


Purpose:  To request that Council approve the proposed Design Advisory Panel key date calendar for 2023.


Recommendation:  That Council approve the 2023 Design Advisory Panel key date calendar as presented.

Purpose:  To introduce an amendment to the Bylaw Notice Enforcement Bylaw in order to add fines for violations associated with the Storm Sewer Regulation and Fee Bylaw 2022 No. 7351.


Recommendation: 


That “Bylaw Notice Enforcement Bylaw 2022 No. 7159.18 (to assign fines for violations associated with the Storm Sewer Regulation and Fee Bylaw) pass first reading.


That “Bylaw Notice Enforcement Bylaw 2022 No. 7159.18 pass second reading.

That “Storm Sewer Regulation and Fee Bylaw 2022 No. 7351” (A bylaw to regulate and collect fees and fines for the storm sewer system service) be adopted.

That Sewer Regulation and Charge Amendment Bylaw 2022, No. 2496.35” (A bylaw to set the 2023 rates for sanitary sewer) be adopted.

That "South West Bulk Water Rate Amendment Bylaw 2022, No. 7099.11” (A bylaw to set the 2023 bulk water rate for South West Extension) be adopted.

That “Municipal Solid Waste Collection Amendment Bylaw 2022, No. 7128.14” (A bylaw to  set the solid waste collection rates for 2023) be adopted.

That "User Fee Subsidies Amendment Bylaw 2022, No. 7095.04” (A bylaw to set the 2023 thresholds for User Fee Subsidies) be adopted.

That "Waterworks Rate and Regulation Amendment Bylaw 2022, No. 7004.18” (A bylaw to set the water rates for 2023) be adopted.

That “Zoning Amendment Bylaw 2022 No. 4500.203” (To rezone 5378 Rutherford Road from Single Dwelling Residential [R1] to Low Density Residential [R6]) be adopted.
