Minutes of the Open Board of Variance Meeting held in the Board Room, Service and Resource Centre, 411 Dunsmuir Street, Nanaimo BC, on Thursday, 2021-JUN-03, at 4:00pm.

Legal description: Lot 1, Section 2, Nanaimo District, Plan 16950

The applicant is requesting an exemption from Section 531 of the Local Government Act to allow the expansion of existing accessory office floor area from 182.74 m2 to 369.38 m2 within an existing non-conforming industrial building. The property was previously zoned for industrial use but is currently zoned R1 Single Dwelling Residential.

Sections 528 to 532 of the Local Government Act stipulate when a non-conforming use is permitted and does not allow the expansion of a non-conforming use or any increase in the degree of activity attributable to the non-conforming use except where an alteration or addition is permitted by the Board of Variance, in accordance with Sections 531 and 542 of the Local Government Act, based on a demonstrated hardship.

 

Legal description: Lot 12, Block 7, Section 1, Nanaimo District, Plan 584 Except The Southerly 4' Thereof

The applicant is requesting to reduce the required side yard setback from 1.5m to 1.01m, and the front yard setback from 4m to 3.72m to raise an existing, non-conforming single residential dwelling and allow a proposed addition. This represents a side yard setback variance of 0.49m and front yard setback variance of 0.28m.

Zoning Bylaw No. 4500 requires a minimum side yard setback of 1.5m and a front yard setback of 4m where a side yard setback of 3m or more is provided on at least one side yard, for properties within the R1 Single Dwelling Residential Zone.
